Victor Ehiakhamen Urged to Submit to DNA Test in Paternity Suit

One Victor Ehiakhamen who is also known as Victor Irekenagba of Opoji has been urged to submit himself to DNA test to determine whether or not he is sired by Mr Eddy Ehiakhamen whom he had been claiming as his biological father, in a parternity suit at the Irrua High Court.
In the suit No. HCI/14/2021 before the Honourable Justice Urho Erhamen of the Irrua High Court, the claimant in the suit, Mr Eddy Ehiakhamen is praying the court for "a declaration that he is not the biological father of the 2nd Defendant"- Victor Irekenagba- avowing that he was not at any time married to one Madam Akhere, the 1st Defendant and mother of the 2nd Defendant in the suit.
He is also praying the court for "an order of perpertual injunction restraining the second Defendant from bearing the Claimant's name or otherwise parading or presenting himself as a child of the Claimant.
"An order of perpertual injunction restraining the Ist Defendant from presenting the 2nd Defendant as the son of the Claimant" and alternatively "an order mandating the 2nd Defendant to submit himself to a DNA paternity test to determine whether he is a child of the Claimant."
Led in evidence by his Counsel, Abhulimen Esq while giving evidence and adopting his statement of Claim when the case came up for hearing on Wednesday, 28 September, the Claimant, Eddy Ehiakhamen avered in his statement of Claim on Oath that he is happily married to Dr. (Mrs) Justina Ehiakhamen, and that they have five children, adding that he has never been married to the 1st Defendant, Madam Akhere stating that the 2nd Defendant is the son of the 1st Defendant.
The Claimant also avered that the 2nd Defendant is not his biological son and has never been acknowledged as his son and further avered "that in 1975, when the 1st Defendant was found pregnant and a family meeting which he was invited to attend to determine the father of the unborn child, he unequivocally denied being the father".
The Claimant also stated that during the period in 1975, "one Mr. Edose claimed to be the father of the child and never relented in his effort to claim the child as his".
While adjourning the case to 28 November 2022, the trial Judge, Hon. Justice Urho Erhamen ordered that further hearing notice be served on the Defendants who were neither present in Court nor represented by counsel and adjourned for cross examination by the Defendants and opening of Defence.
